This Privacy Policy explains how Foody U Limited ("Foody U," "we," "us," or "our"), located at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, collects, uses, shares, and protects your personal information when you use our mobile application, website, and related services (collectively, the "Service").

By accessing or using our Service, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms & Conditions.

  • a. Information You Provide Directly:

    • Account Information: When you create a Foody U account, we collect your name, email address, chosen username, and password.

    • Profile and Health-Related Information: To enable the core functionality of personalized meal generation and other features, we collect information you voluntarily provide, including:

      • Age

      • Weight

      • Height

      • Body fat percentage

      • Gender (optional)

      • Activity level

      • Dietary preferences (e.g., vegetarian, vegan, specific allergies you list, food dislikes)

      • Health goals (e.g., weight loss, muscle gain, maintenance)

    • Other Voluntary Information: Any other information you choose to provide while using the Service, such as feedback or communications with us.

  • b. Information We Collect Automatically:

    • Usage Data: We automatically collect information about how you interact with the Service. This includes features used, recipes generated, meals logged, weight progression tracked, time spent within the app, and frequency of use.

    • Device Information: We collect information from and about the device(s) you use to access our Service, such as your IP address, device type (e.g., iPhone, Android), operating system version, browser type (if accessing via web), and unique device identifiers.

    • Cookies and Similar Tracking Technologies: We use cookies and similar technologies (e.g., pixels, local storage) to operate and improve our Service. Please see Section 9 ("Cookie Policy") for more details.

  • c. Information from and Shared with Third-Party AI Services:

    • AI-Powered Features: To provide certain features, such as our "Nutrition Insights" and potentially other AI-driven functionalities within the Service (e.g., AI-assisted meal planning or recipe generation in the future), we may integrate with third-party Artificial Intelligence service providers, such as OpenAI's API (developer of ChatGPT). When you use these AI-powered features, relevant data you provide or that is generated by our Service (such as dietary preferences, health goals, generated meal plans, or specific queries) may be processed by these third-party AI providers to generate responses, suggestions, or insights. The use of your data by these third-party AI providers is governed by their respective privacy policies and terms. We will only share information necessary to enable the functionality of these AI-powered features.

  • d. Information Related to Coach Services (If Applicable):

    • If you sign up for or connect your Foody U account through a designated third-party coach, personal trainer, university trainer, gym management, or similar entity ("Coach") utilizing our B2B integration, your Coach will have access to the information described in sections 1.a and 1.b that you provide or that is generated through your use of the Service. This is to enable your Coach to provide their services to you through our platform.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To create and manage your user account.

  • To provide the core Service: generating personalized meal plans and recipes based on your input characteristics.

  • To enable other Service features such as weight progression tracking, meal logging, and providing nutrition insights.

  • To personalize and enhance your user experience.

  • To monitor and analyze usage and trends to improve our algorithm, app features, and overall Service.

  • To communicate with you, including responding to your inquiries, sending Service-related updates (e.g., app updates, changes to policies), and, with your explicit consent where required by law, marketing messages.

  • To process payments for subscriptions, in conjunction with our payment processors.

  • To comply with applicable legal obligations, enforce our Terms & Conditions, and protect our rights and the rights of others.

  • For security purposes, including preventing fraud and unauthorized access.

3. Legal Basis for Processing Your Information (Primarily under GDPR and UK Data Protection Act)

Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.

  • Performance of a Contract: We process your information as necessary to perform our contract with you (i.e., our Terms & Conditions) to provide you with the Foody U Service. This includes creating your account and generating personalized meal plans.

  • Consent: We will obtain your explicit consent to process sensitive personal data (such as health-related information like weight, height, body fat percentage, dietary preferences related to health conditions or allergies) for the purpose of providing personalized meal plans and nutrition insights. We will also obtain your consent for sending marketing communications. You can withdraw your consent at any time.

  • Legitimate Interests: We process some information for our legitimate interests, provided these interests are not overridden by your data protection rights. This includes using data for analytics, improving our Service, and for security purposes.

  • Legal Obligation: We may process your information where it is necessary for compliance with a legal obligation to which we are subject.

  • 1.a Third-Party Service Providers: We engage third-party companies and individuals to perform services on our behalf. These include:

    • Hosting Providers (e.g., AWS, Google Cloud, Digital Ocean): To host our application and store data securely.

    • Analytics Providers (e.g., Google Analytics, Mixpanel, Meta Pixel): To help us understand how our Service is used, allowing us to improve it. These providers may use cookies and receive information such as your IP address or device ID.

    • Payment Processors (Apple, Stripe): To process payments for subscriptions. We do not store your full payment card information; this is handled directly by our payment processors.

    • Email Service Providers: To send transactional emails (e.g., account verification, password reset) and, with your consent, marketing communications.

    • Customer Support Platforms: To manage and respond to your support requests.

    • OpenAI (ChatGPT API): As described in Section 1(c), for the "Nutrition Insights" feature. These providers are contractually obligated to protect your information and are restricted from using your personal information for any other purpose than to provide services for us.

  • 1.b Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, prevent or investigate possible wrongdoing in connection with the Service, protect the personal safety of users of the Service or the public, or protect against legal liability.

  • 1.c Business Transfers: In the event of a merger, acquisition, bankruptcy, dissolution, reorganization, sale of some or all of Foody U Limited’s assets, financing, or acquisition of all or a portion of our business by another company, your personal information may be sold or transferred as part of that transaction. We will notify you via email and/or a prominent notice on our Service of any change in ownership or uses of your personal information.

  • 1.d Anonymized/Aggregated Data: We may share or publicly disclose anonymized or aggregated data that does not directly identify you (e.g., usage statistics, demographic trends) for research, marketing, or other purposes.

  • 1.e With Your Explicit Consent: We may share your information with other third parties with your explicit consent.

  • 2.a Sharing with Your Coach (If You Are Onboarded via a Coach): If your Foody U account is created or managed in connection with a Coach through our B2B platform, we will share your personal information with your designated Coach. This includes:

    • Full Profile and Health-Related Information: As described in Section 1.a.ii (e.g., name, age, weight, height, body fat percentage, dietary preferences, health goals).

    • Usage Data: As described in Section 1.b.i (e.g., recipes generated, meals logged, weight progression).

    • Any other information you provide or that is generated through your use of the Service that is relevant to the coaching services.

  • 2.b Your Coach will be able to view this information through their dedicated CRM-like interface within the Foody U platform. They may also have the ability to modify certain aspects of your Foody U plan, such as amending recipes, adjusting calorie targets, or changing meal distributions, as part of the services they provide to you.

  • 2.c Important Note on Coach's Role: Your Coach is an independent third party. Their access to and use of your information via our platform for their coaching services are governed by your direct agreement and relationship with that Coach, and their own privacy practices. Foody U Limited facilitates this data access as requested by you (by signing up through a Coach) but is not responsible for the Coach's own data handling practices or their professional advice. We require Coaches to comply with applicable data protection laws, but you should review your Coach's privacy policy.

  • 2.d You will be clearly informed during the onboarding process if you are signing up via a Coach and that your data will be accessible to them.

5. Data Retention

We will retain your personal information for as long as your account is active or as needed to provide you with the Service. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Generally, we will retain your profile information and usage data for a period of five (5) years after your account becomes inactive or if you request deletion. This retention period is to allow users who may take a break from the app to retain their progress and data should they choose to return. After this period, or upon a verified deletion request subject to legal exceptions, we will take steps to delete or anonymize your personal information.

6. Data Security

We take the security of your data very seriously. We implement a variety of technical and organizational security measures designed to protect the personal information we collect. These measures include, but are not limited to, encryption of data in transit and at rest where appropriate, access controls to our systems, and regular security assessments.

However, please be aware that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

  • Right to Withdraw Consent: If we are processing your personal information based on your consent, you have the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

If you are in the UK or EEA, you also have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.

If your account is managed by or shared with a Coach, requests related to your data (e.g., access, rectification, erasure) may need to be coordinated with your Coach, as they may hold or have modified information relevant to your request. You can also make requests directly to us, and we will process them in accordance with applicable law, coordinating with your Coach as necessary.

You may have the ability to disconnect your account from a Coach through your account settings or by contacting us. Disconnecting may affect the services your Coach can provide to you via our platform.

8. International Data Transfers

Your information, including personal data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction.

If you are located in the UK or EEA, this may mean your data is transferred outside these regions, for example, to servers or service providers located in the United States. When we transfer your personal information internationally, we will take steps to ensure that your information is treated securely and in accordance with this Privacy Policy and applicable data protection laws, such as by using Standard Contractual Clauses approved by the European Commission and UK authorities, or by relying on an adequacy decision.
